I. Details of the seller

II. Conclusion of the contract
We will send you a confirmation of your order within 3 working days at the latest, to the e-mail address you provided during registration (or order). If you do not respond to this confirmation within 24 hours, your order will be considered final.
The date of the order of the goods in question: the date of the advance payment of 100% of the amount due.
 
III. Possibilities of receipt of the goods, means of delivery

We will make every effort to fulfil your order (within 2 weeks for products in stock and 8-10 weeks for products to be manufactured). For each product, the delivery time we undertake is indicated on the product page). The specific delivery time will always be specified in the notification sent to the e-mail address provided during the ordering process. During the ordering process, you have the option to choose between personal delivery or home delivery.
 
III.1.
The ordered goods can be picked up at our premises in Kerta or in our showroom in Budapest at a time agreed in advance by email.
 
III.2.
The products are delivered by courier service or by Plydesign Ltd. truck at a pre-arranged time. Please check the condition of the goods immediately after receipt and report any damage to the goods immediately.
 
IV. Delivery fee, payment options
IV.1:

Between 0 - 5 kg package weight we charge a delivery fee of 8.00 €.
Between 5 - 10 kg package weight we charge a delivery fee of 10.00 €.
Between 10 - 20 kg package weight we charge a delivery fee of 12.00 €.
Between 21 - 30 kg package weight we charge a delivery fee of 18.00 €.
For over 30 kg package weight we charge a delivery fee of 40.00 €.
 
IV.2:
The final purchase price of the goods ordered by you will be included in the order confirmation sent to you. The goods ordered will be packed and shipped once 100% of the payment due has been received.  All prices on plydesign.eu are in euros and include VAT. Payment can be made in euros or in forints, prices in euros are converted into forints at the daily average exchange rate of the MNB.
 
V. Right of withdrawal
Pursuant to Government Decree 45/2014 (26.II.), the customer may withdraw from the purchase without giving any reason within 14 days of receipt (receipt of the product). The purchaser may exercise his right of withdrawal by means of a clear declaration to this effect, or by using the model declaration attached to these GTC or the interface provided for this purpose on the website. Receipt of the consumer's withdrawal notice made via the online interface will be acknowledged.
The customer may exercise his right of withdrawal between the date of conclusion of the contract and the date of receipt of the product.
The date of receipt (receipt of the product) is the date of receipt of the order in the case of receipt in the shop, or the date of receipt from the courier in the case of delivery to the customer's home. These can be proved by the invoice received in the shop or by the receipt from the courier. Personal delivery does not exclude the right of withdrawal.
 
In the event of cancellation, the product must be returned to the seller's premises (Plydesign Ltd., 8492 Kerta, Dózsa u. 58.) at your own expense and in the same way as the delivery chosen when ordering, properly packaged, and we will refund the purchase price of the returned product(s) and any other costs incurred without delay, but no later than 14 days after the return of the product(s). Delivery charges will be refunded in the event of cancellation of the entire order. In the event of cancellation, the customer will be charged only the cost of returning the product, depending on the weight of the package (from 2,000.-Ft to 30,000.-Ft). We will refund the purchase price of the product(s) and the delivery costs (or the amount paid by the buyer as consideration) only if the buyer has returned the product(s) undamaged and in good packaging or has proved beyond doubt that he/she has returned the product(s) within 14 days of the date of the notice of cancellation, whichever is the earlier. Please note that we can only refund the full purchase price paid by you in the event of withdrawal if you return the goods to us in the same condition and undamaged as when you received them. If it can be established that the product has been damaged during use (i.e. it has not legally been tried out), the value of the goods will be refunded less the depreciation of the goods.
 
The refund will be made using the same method of payment as that used for the original transaction, unless the buyer has given his express consent to a different method of payment. In the event of a different method of reimbursement, the buyer shall not be charged any additional costs.
We are not able to accept parcels returned by post.
The buyer may not exercise the right of withdrawal in the cases provided for in Article 29 of Government Decree 45/2014, in particular
in the case of a product that is not prefabricated, that has been produced on the instructions of the customer or at the express request of the customer, or in the case of a product that is clearly personalised (e.g. engraving);
perishable products or products which keep their quality for a short period;
a product in a sealed package which, for reasons of health or hygiene, cannot be returned after opening after delivery; a product which, by its nature, is inseparably mixed with other products after delivery; the sale of a copy of a sound or video recording or computer software in a sealed package, if the buyer has opened the packaging after delivery; The seller may claim damages for loss or damage resulting from the improper use of the goods.
 
VI. Warranty claim
VI.1. Warranty for accessories

In the event of defects in the ordered products, the buyer may assert a warranty claim against the seller under the provisions of Act V of 2013 on the Civil Code. In asserting a warranty claim, the buyer may request the repair or replacement of the defective product, unless the repair or replacement is impossible or would involve disproportionate additional costs for the seller. If the buyer has not requested or could not have requested repair or replacement, the buyer may claim a proportionate price reduction, have the goods repaired or replaced at the seller's expense, or withdraw from the contract if the repair or replacement was not undertaken or could not be carried out by the seller or if the seller has lost its interest in repair or replacement. The burden of proving the loss of interest lies with the buyer. There shall be no right of withdrawal for minor defects. The buyer may switch from one warranty of his choice to another, but he must bear the cost of the switch, unless it was justified or the seller has given a reason for it. The buyer must give notice of the defect as soon as it is discovered and at the latest within 2 months of the discovery of the defect. He may no longer assert a warranty claim beyond the limitation period of 2 years from the date of performance of the contract. Within 6 months from the date of performance of the contract, no other conditions are required for the assertion of a claim for a guarantee other than the notification of the defect and the presentation/submission of the invoice or a copy thereof. However, after 6 months from the date of performance, the buyer is obliged to prove that the defect existed at the time of performance.
 
VI.2. Product warranty
Instead of a warranty for accessories, the buyer may also claim a product warranty from the manufacturer or distributor. In the case of a product warranty, the buyer may only claim the replacement (repair) of the defective product. A product is defective if it does not meet the quality requirements in force when it was put on the market or if it does not have the characteristics described by the manufacturer. In this case, the buyer must prove that the product is defective. A product warranty claim can be made within 3 years of the date of placing on the market. The producer/distributor is exempted from the product liability obligation only if he proves that the product was not manufactured or placed on the market in the course of his business; or that the defect was not apparent from the state of the art at the time the product was placed on the market; or that the defect in the product results from the application of a legal or regulatory provision. The manufacturer/distributor need only prove one cause.
The warranty for accessories and the warranty for the product may not be invoked at the same time and in parallel.
 
VI.3. Warranty
In the event of a defect in a consumer durable good as defined in the Annex to Government Decree 151/2003 (22.IX.), the seller may claim a warranty against the consumer (provided that he is a consumer within the meaning of this Government Decree) within 3 years of the date of receipt. The seller is exempted from the warranty obligation only if he proves that the defect was caused after the delivery. The buyer may claim warranty as explained in the warranty of accessories, with the exception that in the case of a defect in a consumer durable good, we will replace the good within 3 working days of receipt if the defect prevents its proper use (if the good is available in the seller's shop/warehouse) and we will endeavour to repair or replace the good within 15 days if the defect is notified after this period. You can also make your repair request directly to the warranty service (repair service) indicated on the warranty ticket. The buyer may not make both a warranty and a guarantee claim or a product warranty and a guarantee claim for the same defect. However, the rights arising from the warranty shall be independent of the buyer's rights under the accessories warranty and the product warranty.
 
VII. Other provisions
VII.1.
A price which is obviously incorrect due to a system error does not constitute an invitation to tender. The pictures shown next to the products are illustrations, in all cases the product description includes the product characteristics. The seller's liability for any errors that may occur is governed by the provisions of Government Decree 45/2014 (26.II.) and the Civil Code.
 
VII.2. When placing an order, we only ask our customers for information that is strictly necessary to complete the order. This information will not be disclosed to third parties. Exceptions to this rule are information that is necessary for the delivery or shipment of the product.
 
VII.3 Buyers are hereby informed that their personal data will be stored for six months from the date of the order in order to fulfil the contract and to provide subsequent proof of the terms of the contract.
 
VI.4. Our system may collect data on the activity of customers which cannot be linked to other data provided by the customer at the time of registration, nor to data generated by the use of other websites or services.
 
VII.5. We are entitled to send newsletters or other advertising mail to users, provided that the user has given his/her prior, explicit, express and voluntary consent by providing the relevant data at the time of registration. We are under no obligation to verify that the information provided by the user at the time of registration or consent is true or correct.
 
VII.6. The user may withdraw his voluntary consent referred to above at any time without restriction and without giving any reason. The user may withdraw consent by sending an e-mail to info[kukac]plydesign[pont]eu in such a way that the e-mail address to which the user does not wish to receive future information material can be clearly identified. In this case, we will not send the user any more newsletters or other promotional mailings after the withdrawal, and we will delete the user's data from the list of subscribers to the newsletter.
 
VII.7. Reviews and other related opinions about products always reflect the views of users and we are not responsible for their content. We reserve the right to delete any reviews that may be contrary to public taste, business interests or the law.

VII.10.
You may initiate the procedure of a conciliation body for a simple, quick and out-of-court settlement of any dispute with the seller (consumer dispute). The conciliation body competent for the seller's place of business is the Veszprém County Conciliation Board; 8200 Veszprém, Radnóti tér 1 (Fsz. 115-116.).
Valid from 04 February 2023 until revoked and/or amended. Its provisions shall apply only to contracts concluded after its entry into force; earlier contracts shall be governed by the provisions of the general terms and conditions of contract prior to its entry into force.
